These Terms of Use ("Terms") govern your use of the WakeProof mobile application ("WakeProof," "the App," or "the Service") provided by Gimpact ("we," "us," or "our").

By downloading, accessing, or using WakeProof, you agree to these Terms. If you do not agree with these Terms, do not use the App.

1. Description of the Service

WakeProof is a wake-up and alarm application designed to help users wake up by requiring completion of interactive challenges before completing a wake-up session.

Features may include:

• Alarm scheduling
• Repeating alarms
• Wake-up challenges
• Escape-style missions
• Snooze functionality
• Wake-up statistics
• Streaks
• Notifications
• Premium features
• Subscriptions and free trials

Features may change, be added, or be removed over time.

2. No Guarantee of Waking You Up

WakeProof is a tool intended to assist with waking up. It does not guarantee that you will wake up on time.

WakeProof depends on your device, operating system, notification permissions, device settings, battery status, audio settings, and other technical conditions outside our control.

You are responsible for ensuring that your device is configured appropriately for alarms and notifications.

For important appointments, travel, work, medication schedules, or other time-sensitive obligations, you should consider using an additional reliable alarm or backup method.

WakeProof should not be relied upon as the sole means of waking you for safety-critical or legally significant activities.

3. Device Permissions

Certain WakeProof features may require device permissions, including notification access and, for optional features, camera or other system permissions.

You may deny these permissions, but doing so may prevent certain features from functioning correctly.

You are responsible for maintaining appropriate device settings for the features you choose to use.

4. User Responsibilities

You agree to:

• Use WakeProof only for lawful purposes.
• Provide accurate information when information is requested.
• Maintain control of your device and account.
• Not attempt to reverse engineer, modify, or interfere with the App.
• Not attempt to bypass security or subscription restrictions.
• Not use the App to harm, harass, or interfere with another person.
• Comply with applicable laws and regulations.

5. Subscriptions

WakeProof may offer auto-renewing subscriptions.

Subscription prices, durations, available plans, and features will be displayed in the App Store or within the App before purchase.

If you purchase a subscription, payment is charged through your Apple App Store account.

Subscriptions automatically renew unless canceled in accordance with Apple's subscription rules.

You are responsible for managing your subscription through your Apple account.

6. Free Trials

WakeProof may offer a free trial for eligible users.

If a free trial is offered:

• The duration will be displayed before you start the trial.
• You will not be charged during the applicable free-trial period unless otherwise stated.
• If you do not cancel before the trial ends, your subscription may automatically renew at the displayed subscription price.
• Trial eligibility is determined by Apple and applicable subscription rules.

Any trial terms shown at the time of purchase take precedence over general descriptions in these Terms.

7. Cancellation

You may cancel an Apple App Store subscription through your Apple account's subscription management settings.

Deleting the WakeProof App does not necessarily cancel your subscription.

Cancellation generally prevents future renewal but does not automatically provide a refund for a period already paid for, except where required by applicable law or Apple's applicable policies.

8. Refunds

Purchases made through Apple's App Store are subject to Apple's refund policies and procedures.

We do not guarantee refunds except where required by applicable law.

9. Intellectual Property

WakeProof, including its software, interface, graphics, sounds, animations, logos, trademarks, text, challenge designs, and other content, is owned by or licensed to us and is protected by applicable intellectual-property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use WakeProof for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy the App
• Modify the App
• Distribute the App
• Sell or sublicense the App
• Reverse engineer the App except where expressly permitted by law
• Extract proprietary content
• Create derivative works based on the App

10. User-Generated Content

If WakeProof allows you to create or submit content, such as custom challenges, labels, images, or other material, you remain responsible for that content.

You must not submit content that:

• Violates applicable law
• Infringes another person's rights
• Contains malicious software
• Contains unlawful or abusive material
• Attempts to compromise the Service

Where necessary to operate the Service, you grant us a limited license to process and display such content.

11. Third-Party Services

WakeProof may integrate with or rely upon third-party services, including Apple's services.

Third-party services may have their own terms and privacy policies.

We are not responsible for the independent operation, availability, or policies of third-party services.

12. Availability and Changes

We attempt to keep WakeProof available and functional, but we do not guarantee uninterrupted or error-free operation.

We may:

• Modify features
• Add or remove functionality
• Update the App
• Temporarily suspend features
• Discontinue portions of the Service

We may do so for technical, security, business, legal, or operational reasons.

13. Disclaimer

To the maximum extent permitted by applicable law, WakeProof is provided on an "as is" and "as available" basis.

We do not guarantee that:

• The App will always be available.
• Every alarm will function under every device configuration.
• Notifications will always be delivered.
• The App will be compatible with every device or operating-system version.
• The App will wake you up.
• Challenges will always function without errors.
• The Service will meet your particular requirements.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Gimpact and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of WakeProof.

This includes, without limitation, losses arising from missed appointments, missed flights, missed work, missed school, late arrival, or failure to wake up.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Gimpact and its officers, employees, contractors, and affiliates from claims, damages, liabilities, and expenses arising from:

• Your misuse of WakeProof
• Your violation of these Terms
• Your violation of applicable law
• Your infringement of another person's rights

16. Termination

We may suspend or terminate your access to WakeProof if you materially violate these Terms or misuse the Service.

You may stop using WakeProof at any time.

Termination does not affect rights or obligations that by their nature should survive termination.

17. Privacy

Your use of WakeProof is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, and protect information.

18. Governing Law

These Terms are governed by the laws of [Jurisdiction/Country], except where applicable law requires otherwise.

Any disputes will be handled by the courts or dispute-resolution mechanisms applicable under the laws of that jurisdiction, subject to any mandatory consumer-protection rights.

19. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may provide notice through the App or another appropriate method.

Your continued use of WakeProof after the updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

21. Apple-Specific Notice

WakeProof is distributed through Apple's App Store.

Apple is not responsible for providing maintenance or support services for WakeProof.

To the extent applicable, Apple's standard App Store terms and conditions also apply to your use of the App.

Apple is not responsible for addressing claims relating to WakeProof, except as otherwise required under applicable law.
